[OSM-newbies] Where is the line between "facts" and "creative works"?

The particular dataset I'm interested in right now is produced by 
a county-government consortium in California.  I've got 
some rather imprecise verbal permission to import the shapes to OSM, 
but I doubt the legal authority of that person to do so.
