Everyone who has accepted the new terms has agreed that their work can 
be distributed under both ODbL and CC-BY-SA.

At present OSM is distributing the data under CC-BY-SA, because the work 
of those who have _not_ agreed to the terms hasn't yet been removed from 
the database.

As soon as it has done (and I believe work is progressing to schedule), 
then we will switch to distributing it under ODbL.
