I'm wholehearted in favour of this way forward. I agree that the
checkbox was well intended, but it serves no practical purpose and is,
at best, misleading both for the person signing up, and also anyone
who wants to rely on it for any reason.

I'd be happy to see a Board agreement to remove it from the website.
