The comment [above](https://github.com/openstreetmap/openstreetmap-website/issues/5804#issuecomment-3638311030) establishes that the LWG opinion is

> Therefore, we need to at least provide an opt-out, but neither the privacy policy nor the GDPR would require us to make it an opt-in

If you disagree with the LWG opinion you need to raise it with them.
