Oliver,

    you keep talking of "waterproof" statements about what is allowed 
etc.; but the situation is, with the old as with the new license, that 
we cannot give such statements.

Both the old and new license have lots of gray areas.

If you really want "waterproof" stuff then you'd have to make sure that 
there is only one party that can sue people for breach of license. You 
could, for example, modify the contributor agreement in a way that makes 
the individual contributor relinquish his right to sue anyone, and 
instead gives that right to OSMF exclusively. If you did that, then OSMF 
could issue legally binding statements of the type "we guarantee that we 
will not sue you if you do X".
