I fully understand that there are gray areas. I even know that interpretation vary from court to court. I also fully understand that there is always a legal risk. 

However, the real problem is not the lack of waterproof statement but the lack of sufficient guidelines to judge the risk. If the different possible interpretations would be made transparent then people would understand where the risks are. So far, the biggest risk is that people have no clue what risks might arise.

They only know that proprietary data might be shared if they use it in combination with OSM data. That is the generic statement that is in the air and there is no place where you can dig into the topic to evaluate the risk for your personal use case.
