as far as I understand your answer you say that the (OSM) world is perfect and there is no need for change. At least I do not a hint where you could imagine a change because the world is so complicated. 

If lawyers would not be helpful nobody would pay them. Even if they cannot give waterproof statement, they can assess the risk, which is sufficient in most cases.

That is why the risk of license is unclear to the big companies.
