I don't think Tom ever mentionned that the OSM world is perfect. It was a
rather matter of fact statement. Odbl should be easier for potential
business user on the produced work. While it is actually painful, keeping
the two database separate in terms of data is one way of being safe.
The whole debate really reminds of the old reharsed argument of GPL with the
same conclusion in the end pretty much except for the difference between
derived database and produced work. Yes, and many lawyers were initially in
the US pointing out that the GPL wouldn't hold in court.
The fact is that currently the data is under share alike and and it is bound
to remain so due to the very nature of the licence.
At best, the foundation can potentially hire a lawyer to issue guidance on
the licence, but we can't hire a lawyer every time someone asks a slightly
different question. Big companies will anyway hire lawyers and will not
trust any guidances that you will give them as they will refer to the text
in the end.
