Suite à la lecture du blog de Richard Weait:

Je suis tombé sur cet outil qui permet d’évaluer la compatibilité des licences:

On y mentionne une incompatibilité entre CC-BY-4.0, la nouvelle licence utilisée par le Gouvernement du Québec ainsi que les villes de Montréal, Québec, Gatineau et Sherbrooke, ainsi que la ODC-ODbL-1.0, la licence couvrant la base de données d’OpenStreetMap.

Cette incompatibilité serait due au fait que la CC-BY-4.0 interdit toute distribution sous verrou numérique (DRM), tandis que l’ODbL le permet, à condition qu’une version non verrouillée soit également fournie.


Voici l’explication dans le résumé « humain » de chaque licence:

CC-BY 4.0:
  No additional restrictions — You may not apply legal terms or technological measures that legally restrict others from doing anything the license permits.

ODbL 1.0:
  Keep open: If you redistribute the database, or an adapted version of it, then you may use technological measures that restrict the work (such as DRM) as long as you also redistribute a version without such measures.


Cependant, une analyse du texte m'indique que les deux licences seraient compatibles, et que le CLIPol a mal catégorisé les licences.

a. License grant.

4. Media and formats; technical modifications allowed. Selon ma compréhension, ce texte n’interdit pas formellement la distribution avec DRM, il stipule simplement que si le contenu distribué sous CC 4.0 l’est sous forme de DRM, alors il est permis d’utiliser des outils pour enlever le DRM.

4.7 Technological measures and additional terms

      a.       b. Parallel distribution. You may impose terms or technological measures on the Database, a Derivative Database, or the whole or a Substantial part of the Contents (a “Restricted Database”) in contravention of Section 4.74 a. only if You also make a copy of the Database or a Derivative Database available to the recipient of the Restricted Database:

           i. That is available without additional fee;

           ii. That is available in a medium that does not alter or restrict the terms of this License, or any rights granted under it, or have the effect or intent of restricting the ability of any person to exercise those rights (an “Unrestricted Database”); and

           iii. The Unrestricted Database is at least as accessible to the recipient as a practical matter as the Restricted Database.

      c. For the avoidance of doubt, You may place this Database or a Derivative Database in an authenticated environment, behind a password, or within a similar access control scheme provided that You do not alter or restrict the terms of this License or any rights granted under it or have the effect or intent of restricting the ability of any person to exercise those rights.




Ici, l’ODbL permet la distribution avec DRM, à condition qu’une copie gratuite sans DRM soit également distribuée. Les deux licences sont dont compatibles à mon avis, étant donné qu’il suffit d’utiliser la version sans DRM pour circonvenir le DRM et respecter les termes de la CC 4.0.

PS: il resterait un point à analyser selon le CLIPol, concernant les droits moraux.
