Two separate issues here, I think.

I can limit the counties to exclude those where the data hasn't been released under OGL - that's fine. I strongly suspect this is more a theoretical point than an actual real-world issue but I do see the legal rationale for it.

_But_ there are authorities that have explicitly released their datasets as OGL but aren't on the Attribution page. For example, the Brecon Beacons and Calderdale are both on data.gov.uk with an explicit OGL licence. With these, it would be more sensible to retain them but add the relevant verbiage to the Attribution page. I'll do a quick scout through and see how many of these I can find trivially.
