I doubt the goat asked permission to create the path!

I also doubt that digging up a shovelful of earth and stones, and then 
putting them back where they came from, can be described as damaging the 
mountain.

The OP said he was a member of the mountain rescue team, and presumably 
in contact with the local authorities.

The day after correctly mapping a gap in the path, he could go back and 
trample it back down if it bothers anyone.
