I would say that was criminal damage, if done by anyone except the 
landowner.

Also, I live near part of the route of an, over 100km long, regional 
walking route, at a point where it crosses a park.  There is no visible 
track on the ground.  I don't think people would be happy if one deleted 
that section of the relation, because it was not visible. There is, as 
hinted above, a trail_visibilty attribute, that includes paths with no 
visibility at all.  I might add that when I've double checked how much 
of is essentially invisible, and whether there are any points where the 
grass is sufficiently disturbed to make slightly visible.

Although I didn't map it, myself, I would agree that there is a more 
definite route than just "across the park".  In any case, people don't 
seem to like routes which include areas, and it is impossible to stop 
them adding virtual paths over such areas (sometimes impossible ones, 
e.g. going over the top of statues or war memorials).
