Hi Jason,

I mentioned this in your repo but thought I would also mention it to this list. The Microsoft legal team reviewed this particular scenario and determined that it is consistent with the current terms of the imagery as it relates to contributing to OSM.  You're welcome to use the Bing imagery as an input to this process.

Before I started this project in November I contacted the Bing licensing group, described my intentions, and asked for a developer key. They responded by giving me instructions on how to get a developer key.

I imagine they don't get many requests like this and it turns out they didn't understand what I was asking them. Today I was contacted by Microsoft with the news that they are not sure if the upstream licenses they have with the satellite image vendors allows them to grant OSM permission to do this kind of project.

The good news is that they indicated that they are going to try to grant permission for this use case for OSM. The issue has been escalated into the legal team at MS.

I am sure Microsoft will communicate with us when they decide what to do, until then we have to wait.
