Yes, he will be responsible for his actions, but not for the actions
of OSM. Its really hard to emphasise this enough.
I don't like repeating myself like some drunk in a bar, and I feel
like people are saying the same thing again and again to agrue their
cases. Some things won't change with a privacy policy and OSMF - you
are right. The Freedom of Information Act deals with information that
may at some time in the future by used to breach someone's privacy,
like OSM traces and edits. So OSMF will still be legally responsible
and the Officers/Board will have to decide how they interpret and obey
the law. Its the difference between having a limited liability
company and being personally liable.
Maybe this is a crucial point though - if the law in UK is so
unfriendly towards what we are doing, perhaps we will have to see
about hosting somewhere that is more liberal?
With regards to the "soap opera" you got in reply - I understand your
point. But I guess we all have to bare in mind the limitations of
communication via email - what's the figures - like 60% of
communication is non-verbal? Something along those lines, which is
one of the reasons I was keen to start the London list and the London
meetings, and why the 2nd Birthday will be so cool. Still, you you
and others feel that you got a load of spin, which I understand. But
whilst we have heard a lot of differnt reasons for not releasing data,
there have a been a lot of different motives put forward for the whole
'conspiracy agains the membership' idea - what could be motivating
that - if anything - there is no good reason.
