I didn't read everything, your formatting bugged me.

But I normally do downloads in josm as follows:
 - Load a gpx file into josm
   then josm automatically zooms in a way so the complete 
   gpx file can be seen. 
 - Then maybe adjust your zoom and panning to the area 
   you want to edit.
 - Say download, uncheck the "as tracks" and then say OK. 
   You get the area which was displayed on the 
   screen before you pressed download.
