As far as I understand matters:

a) OSM has an agreement with Yahoo! allowing certain uses of their 
imagery, this being one of them

b) When tracing satellite photos in this way, you're probably creating a 
new work, not copying the old one.

I may be wrong on either point.  I am not a lawyer, nor do I play one on 
TV.  This is not legal advice.
