The phrase "fair use" is from US law, yes, but to say "there is no
concept of fair use" is slightly exaggerating - it's not that it doesn't
exist, it's just that it has a different name, "fair dealing", and it is
less powerful.

But I don't think that either the legal term "fair use" or "fair
dealing" is applicable here - they are both about quoting other peoples
work in reference, not about deriving information.

The argument we are having is to what extent copyright applies to the
information conveyed in a work where that information is a collection of
facts that are discoverable elsewhere. This is probably more database
rights territory, rather than copyright.
