True. That's because JOSM currently has no "state" information. You
know that you are just creating a way, but all JOSM knows is "there is
a node selected which is used by two ways - phew I don't know which
one to connect to, so start a new way".

Could be overcome, perhaps, by having the way instead of (or in
addition to) the node selected when you enter new ways. That would
also make it easy to tag once it's finished.

This can be overcome by using the "alt" modifier key.
