I believe the distinction here is between "referencing" and "using".
I.e. nothing can stop you making yourself aware of something by looking
up a reference book, map, photo etc but that does not necessarily allow
you to "use" the information for your own work. For that you need to do
your own labour, like going out and surveying.
FYI, this came up when we, the then OSMF License Working Group were
talking to the South African mapping directorate, who were very
cooperative. They monitor OpenStreetMap for changes, and then send their
folks out to do a detailed survey. It allows them to concentrate their
resources and we were quite happy about that. Seems a similar situation
here.
