It never accepted empty layers. If you didn't select any layer, it would choose the default set of layers (tile, maplint, captionless). Either something went wrong with the layer sanity check that I introduced yesterday, or something weir with database transactions is happening, or the brutal killing of mysql/upload preocessor yesterday left thing in an inconsisten state.
