That's true.
But in reality, users only tend to use a black or a white background (at
least in JOSM). So if you deal with these two situations you're mostly done.
Interestingly, there's no other problem in this regard reported. Even if
you have different colours on the map (e.g. green for a park), the icon
seems to be doing "a good job".
Only black and white backgrounds seems to be problematic ...
