If KOGL type 1 is equivalent to CC-BY 4.0 then additional waiver is 
apparently needed per https://wiki.openstreetmap.org/wiki/Import/ODbL_Compatibility

If it is equivalent to earlier CC-BY then it is likely unusuable.
