It's additional information to ground surveys and should independently
recorded. Rights of way are distinct from path on the ground used for
walking on and should be denoted as such. It's not entirely academic as
there are numerous examples of land owners unilaterally illegally moving
or removing footpaths that are rights of way.

It's not clear from here:
http://wiki.openstreetmap.org/wiki/UK_access_provisions that the legal
distinction is sufficiently unambiguous for rights of way. "Public
footpath" doesn't seem to make the distinction at all clear to me.
