Part of the problem here is that, unlike OS maps, the standard OSM 
render doesn't show right of way status. You can get it by querying 
individual features, but there's nothing visible in the layer itself. So 
it's not unreasonable that someone more familiar with the OS way of 
doing things will look at a track on OSM and assume that its presence on 
the map implies that it's publicly accessible - or, at least, that the 
mapper thinks it's publicly accessible.

And another solution, if and when it ever becomes a thing, is for an 
OSM-GB stylesheet to include right of way status as part of the default 
render.
