I reckon the question of what constitutes a derived work is one that's 
going to have to be addressed, isn't it? I mean you could just harvest 
the whole postcode database from streetmap.co.uk but I imagine that 
would be an infringement :)

Where's the line between checking data we have against published 
sources and just wholesale poaching those resources?

I actually have a circa 2000 copy of the postcode data that was bought 
for a client back then. I've also been working on code that can 
generate usable postcode boundaries from postcode locations - but I'm 
reluctant to join the two up and produce what would clearly be a 
derived work. Anyone know a clever lawyer? :)
