It's an open question whether such activity is illegal if the access
point allows open access. Cracking WEP keys is almost certainly
illegal, but if the access point is open, i.e.  allows anyone to
connect then anyone accused of bandwidth "theft" could argue that the
DHCP server gave them an IP address, when their laptop asked for one,
and so was not doing anything unauthorised.
